DFA seeks senators’ help on Rome Statute
FOREIGN Affairs Secretary Albert del Rosario on Thursday urged senators to give their concurrence for the ratification of the Rome Statute of the International Criminal Court (ICC) as this would manifest the Philippines’ commitment to international law.
The Senate Committee on Foreign Relations and the Sub-committee on the ICC, led by Senators Loren Legarda and Miriam Defensor-Santiago, began ratification proceedings on the ICC also on Thursday.
“Only now and under (President Benigno Aquino 3rd) is our country in the process of finally ratifying the Rome Statute. We’re hopeful that this Senate will give its concurrence post-haste,” del Rosario said.
“The position that we take on this important issue reaffirms our country’s leading role in promoting justice, peace and the rule of law in Asia, being a model of democracy in this part of the world,” he added.
In March, President Aquino forwarded pertinent documents to the Senate for the ratification of the ICC Rome Statute.
The President then ratified the Rome Statute on May 6, 2011.
But under the Philippine Constitution, treaties ratified by the President need the concurrence of the Senate before these can enter into force and effect.
Mr. Aquino also met with ICC President Sang Hyun-Song in March as part of the ICC chief’s bid to attract more countries to ratify the Rome Statute.
The Department of Foreign Affairs (DFA) has been an ardent advocate of Philippine ratification of the Rome Statute through the years.
Under Secretary Teofisto Guingona Jr., the department recommended its ratification to then-President Gloria Arroyo in 2002 and under Secretary Blas Ople resubmitted the same to the President in 2003.
The Rome Statute was concluded in 1998 by the United Nations Diplomatic Conference of Plenipotentiaries on the Establishment of an ICC that was participated in by some 140 states, including the Philippines.
The statute entered into force on July 1, 2002, after 60 states had become parties.
The ICC, which is headquartered in The Hague, the Netherlands, has jurisdiction over the most serious crimes of concern to the international community, namely genocide, war crimes, crimes against humanity and aggression.
To date, there are 116 states that have either ratified or acceded to the Rome Statute, 15 of which are from Asia and the Pacific, including Cambodia, Timor Leste, South Korea, Australia and Japan.
Meanwhile, the Philippine Coalition for the International Criminal Court, a network of rights group, also on Thursday called on the Senate to ratify the Rome Statute at the earliest possible time.
“Your completion of the ratification of the Rome Statute by the Philippines will manifest the commitment of our country to give justice to victims,” the PCICC said in an open letter to Senate.
The treaty, the PCICC reminded, addresses impunity done against Filipino either locally or overseas.
