Motion to suspend Clark airport prexy denied

CLARK FREEPORT — The Ombudsman has denied the motion of Candaba Mayor Jerry Pelayo and officials here to suspend Clark International Airport Corporation President Victor Jose I. Luciano.
The suspension call was made in connection with the controversial donation to Aetas of dilapidated buildings inside the aviation complex.
The Office of the Ombudsman found out that CIAC management followed processes based on directives from Malacañang.
The Ombudsman also stated that the CIAC fact-finding committee is “not competent” to determine whether questioned buildings were serviceable or not.
The committee was organized to conduct an investigation regarding the alleged irregularity in the donation and demolition of old buildings inside the aviation complex.
Acting Ombudsman Orlando C. Casimiro noted that the CIAC management led by Luciano and other CIAC managers “merely followed legal processes as shown by the corresponding endorsements of CIAC management and their own COA resident auditor.”
The old dilapidated buildings were donated to the Bamban Aeta Tribal Association.
The Aeta associations have acknowledged the donations of the unserviceable buildings that had been used in buying food and medicine for their members.
Some of the proceeds were also used in the improvement of their school and day-care centers.
“The complainants and members of the Fact Finding Committee are not experts and competent in determining whether or not the questioned buildings were still serviceable/usable,” the decision stated.
The fact-finding committee was composed of former CIAC Chairman Nestor Mangio and Board Members Rafael Angeles and Jess Nicdao.
The Ombudsman found out that on April 29, 2009, former undersecretary Chato Eliger of the Presidential Management Staff requested Luciano to donate to the Bamban Aeta Tribal Association Incorporated the “Former Old US Dairy Plant” buildings “Nos. 3 & 4” and other unusable materials.
Eliger, in his letter to Luciano, asked the CIAC management to “follow processes, make sure, structure, if any, have been determined to be beyond repair and no longer usable and serviceable, may cause harm/injury/death to the people if not demolished.”
“It appears from the case records that there were official directives from Malacañang or the Office of the Presidential Management Staff for such demolitions and donations to Aeta associations and the respondents merely followed the legal processes as shown by the corresponding endorsements of CIAC Management and their own resident COA auditor,” the decision read.
Demolition permits were also issued by the Clark Development Corporation’s Building, Utilities and Regulatory Department upon the endorsement by CIAC management and the Commission on Audit’s resident auditor that the old buildings were beyond repair.
The Ombudsman also stated that “the pieces of documentary evidence presented by the complainants do not establish that the guilt of the respondents on the alleged administrative infraction/charge against them is strong.”
