Prosecution ‘not defeated’ in move to prove Corona’s ill-gotten wealth
MANILA — Malacañang said the prosecution did not suffer defeat when the Senate impeachment court barred it from presenting evidence pertaining to alleged ill-gotten wealth of Chief Justice Renato Corona.
Presidential spokesperson Edwin Lacierda said Thursday the prosecution showed to the senator-judges that there was “legal presumption” of ill-gotten wealth based on Corona’s income tax returns and his properties declared in his statements of assets, liabilities and net worth (SALN).
“The impression that came out yesterday (Wednesday) was that the prosecution suffered a defeat. But I think if you look at, if you listen to the statements made by Senate President Juan Ponce Enrile, he allowed the introduction of evidence on the ITR; he allowed the evidence on properties,” he said
“So, the minute you presented the buildings, the properties acquired, and the minute that you showed that this income as reported is not commensurate to buy those properties, the presumption of law of ill-gotten wealth arises,” he added.
Lacierda said the burden is now shifted to the defense to prove that the properties of Corona were not acquired illegally.
He said Senator Enrile even said that the Chief Justice is “not yet off the hook.”
The Senate on Wednesday ruled that the prosecution will only be allowed to present evidence on paragraphs 2.2 and 2.3 but not on 2.4 of the Article 2 of the impeachment complaint.
Paragraph 2.2 refers to Corona’s alleged failure to disclose his SALN while 2.3 states the respondent’s supposed non-inclusion of some of his properties in his SALN.
Paragraph 2.4, meanwhile, accused the respondent of “having accumulated ill-gotten wealth, acquiring assets of high values and keeping bank accounts with huge deposits.”
Malacanang also expressed support on the plan of the 188 congressmen who signed the impeachment complaint against Corona to start an information drive regarding the articles of impeachment.
While this move might be considered in defiance of the rules set by the Senate, Lacierda said there is nothing wrong with the plan of the lawmakers.
“This is a free country. The gag rule was applied only insofar as the defense and the prosecution. And this is one way of explaining to the public — those who perhaps have no access to radio or television — what’s going on with respect to the impeachment of Chief Justice Corona,” he said.
Lacierda denied that the Palace was behind the information campaign plan.
He recognized, however, that the lawmaker’s plan could be considered as trial by publicity, saying the senators will be the one to decide on the trial.
With the developments in the impeachment, Lacierda said the Palace is confident that Corona will be convicted.
He also expressed high hopes on the leadership of Enrile as presiding officer of the impeachment court.
“By upholding the rule of law and giving both the defense and prosecution panels leeway in presenting their cases, Senate President Enrile has judiciously steered the trial towards its rightful course — the pursuit of truth and accountability,” said Lacierda.
“In line with the presiding officer, the senator-jurors have likewise expressed their overwhelming desire to shed light on the allegations and appraise the evidence presented despite the incessant and at times unproductive objections,” he added. (Jill Beltran/Sunnex)
