Senator: No need for special group to probe poll fraud

SENATE President Juan Ponce Enrile on Wednesday said alleged cheating in the 2004 and 2007 elections can be investigated and prosecuted even without a special fact-finding body proposed by a fellow senator.
“In my view, we shouldn’t do that anymore,” he said, adding if there was cheating in elections during the term of former President Gloria Macapagal-Arroyo and if there is evidence to prove it, the government should bring Arroyo to court.
Senator Francis “Chiz” Escudero earlier called for the government to form an independent body that will probe the alleged election cheating that transpired in 2004 and 2007.
Enrile said if the objective of the proposed commission is to punish poll fraud architects, then “the case of Maguindanao will be enough.” “If there was cheating there, that’s a crime,” he said.
Massacre suspect Zaldy Ampatuan and former Maguindanao election supervisor Lintang Bedol have alleged Arroyo’s participation in vote shaving and padding.
Escudero filed a joint resolution, which will need approval from both Houses of Congress, to create a fact-finding commission to put to rest allegations that Arroyo cheated in the 2004 presidential elections.
Escudero was spokesman for Fernando Poe Jr., who ran and lost against Arroyo in 2004.
“The ghost of 2004 has continuously haunted our democratic system and electoral processes. We need to establish a fact-finding commission, define its powers and functions to enable it to make recommendations on who to recognize as the true 15th president of the republic,” he said Tuesday.
Enrile said a commission could be formed “for that purpose only” but Escudero said Wednesday that the commission might help prosecute
Arroyo if it finds evidence to recommend that.
“Any findings submitted to the fact-finding commission, if it is under oath, can be used as basis in filing a criminal complaint,” he explained.
He said the proposed commission should “at the very least” invite Arroyo to give her due process.
Bayan Muna party-list Representatives Teddy Casiño and Neri Colmenares have filed a resolution to probe allegations of fraud in the 2004 and
2007 elections but it is not related to Escudero’s measure.
“We’re proposing a House inquiry, which is immediate,” Casiño told Sun.Star.
Lawyer Raul Lambino, Arroyo’s legal counsel, has criticized the move, saying it will just waste resources.
“We don’t see any value (in that) except to advance the agenda of personalities. Maybe some are congressmen who want to be elected or re-elected in 2013 and perhaps become President in 2016,” he said. (Jonathan de Santos/Virgil Lopez/Sunnex)
