6,200 take bar exams at UST

ABOUT 6,200 law graduates trooped Sunday to the University of Santo Tomas (UST) to take this year’s Bar examinations amid tighter security employed by court officials to avoid a repeat of last year’s violent grenade hurling incident.
Uniformed and plainclothes agents of the Manila Police District and National Bureau of Investigation were posted in strategic locations inside the campus as early as Saturday to ensure peace and order.
Metro Manila Development Authority personnel were in charge of traffic, which was expected to be heavy due to the influx of barristers to the venue.
As early as 6:30 a.m., law students started arriving at the campus for the first of four days of exams, which shall take place on all four Sundays of November, to be held at the UST main building and high school building, which is closest to the gates on P. Noval and Dapitan streets.
To ensure a more orderly holding of the bar exams, the Supreme Court has directed law schools and other groups to refrain from conducting bar operations so close to the university.
Bar operations is traditionally carried out by law schools and various law groups to provide technical support to barristers in terms of food, lodging, review materials and others. Usually, these groups set up streamers, conducts sendoffs and cheering squads.
Supreme Court Associate Justice Roberto Abad said the coverage of this year’s bar exams shall now be drawn up by topics and sub-topics rather than by simply stating the covered laws.
The measures were undertaken following the grenade blast hurled by a member of a fraternity that marred the otherwise peaceful holding of the 2010 bar exams, injuring close to 50 law students and revelers outside the De La Salle University campus on September 26 during the traditional “Salubong.”
Among those who sustained grave injuries was San Sebastian sophomore Raissa Laurel who had to have both her legs amputated.
Last April, the Department of Justice recommended the filing of multiple frustrated murder and multiple attempted murder against Anthony Leal Nepomuceno, a member of the Alpha Phi Omega (APO) fraternity and principal suspect behind the blast.
Nepomuceno, a call center agent, is also found liable for illegal possession of explosive, referring to the MK2 fragmentation hand grenade which he allegedly lobbed at the camp of a rival fraternity during the “Salubong”.
For this year, several changes have also been made in the holding of the bar exams.
For the first time, bar exams will be held in November to avoid the heavy downpour that usually occur in the month of September, the traditional month of the bar exams.
This year’s exams also features multiple-choice questions that are to be so constructed as to specifically measure the candidate’s knowledge of and ability to recall the laws, doctrines, and principles that every new lawyers needs in his practice, and assess the candidate’s understanding of the meaning and significance of those same laws and principles as they apply to specific situations.
The exams shall also include essay-type questions that will not be Bar subject specific. One such essay examination will require the candidate to prepare a trial memorandum or a decision based on a documented legal dispute. This essay will account for 60 percent of the examinations’ essay portion. The remaining 40 percent will be covered by an essay that will require the Bar candidate to prepare a written opinion sought by a client concerning a potential legal dispute facing him or her.
In computing a candidate’s final grade in the Bar examinations, the results of the multiple-choice questions examinations will be given a weight of 60 percent, while those of the essay-type examinations will be given a weight of 40 percent.
Since this is the first time that that the new format will be implemented, the answers of all candidates in the essay-type examinations will be corrected irrespective of the results of their multiple-choice questions examinations, which are known earlier because these will be checked electronically.
In future Bar examinations, however, the Bar chairperson shall recommend to the Court the disqualification of those whose grades in the multiple choice questions are so low that it would serve no useful purpose to correct their answers in the essay-type examinations. (ECV/Sunnex)
