Battle vs Supreme Court ‘not about revenue share’

CITY OF SAN FERNANDO — The League of Cities of the Philippines’ (LCP) battle against a Supreme Court order upholding 16 new cities is beyond the issue of its Internal Revenue Allotment (IRA) share, an official said.
The LCP’s opposition to the cityhood laws of 16 new cities was construed by some sectors as a move by the 122-member influential league to protect their IRA shares.
“The IRA is just an incidental issue. The real reason is about violation of the Constitution and the local government code. This is a grave error which I think should be addressed,” said Mayor Oscar Rodriguez, LCP president.
The city is bound to lose more than P20 million in IRA, with other members like Olongapo and Puerto Princesa getting slashes of up to P100 million.
Rodriguez said that under Section 10, Article 10 of the Constitution, “No province, city, municipality, or barangay may be created, divided, merged, abolished, or its boundary substantially altered, except in accordance with the criteria established in the local government code.”
Under the Local Government Code, as amended by Republic Act 9009, a municipality may be converted into a component city only if it meets two of three requirements: locally generated average annual income of P100 million for the last two consecutive years and contiguous territory of at least 100 square kilometers or a population of not less than 150,000 inhabitants.
He noted that all the 16 towns allowed by the Supreme Court to become cities failed to meet the P100-million income requirement.
One of the towns, El Salvador in Misamis Oriental, even failed to meet all the requirements set by the Local Government Code on cityhood.
LCP secretary general Hernani Braganza, for his part, chided the Supreme Court for “not having the guts” to announce in public that it had ruled to proclaim the unqualified municipalities as cities.
It was reported in several media outlets that the Supreme Court, in an en banc session last Tuesday, decided to junk the motion for reconsideration filed by the League of Cities against the conversion of the 16 municipalities into cities.
But Braganza noted that the Supreme Court decided to leak the ruling to the media instead of announcing it in a press conference as had previously done by Court spokesman Midas Marquez.
