Case vs. Edpam a booboo–city lawyer
ANGELES CITY – The filing of graft charges against Mayor Edgardo Pamintuan on the hiring of job order workers is a “dud or legal booboo,” said City Legal Officer Reymon Fabros.
According to Fabros, the Civil Service Commission (CSC) memorandum circular Nos. 17 and 24, which the complaint cited as basis for the case, have been repealed by the CSC itself on December 20, 2006 as per CSC Resolution No. 06-2254.
“I advise them that they should consult a competent lawyer before filing a complaint,” said Fabros.
Robledo Sanchez, a tabloid stringer, last Oct. 19 filed a complaint against Pamintuan before the Ombudsman for graft on the hiring of job order workers whose contracts were allegedly not cleared with the CSC.
Pamintuan had said Sanchez was just a “hireling” of Congressman Carmelo “Tarzan” Lazatin, his political rival for the mayoralty of the city.
“I am sorry to say that the case is a product of gross ignorance. Had they done a little bit of research, they should have learned that there is no basis for their complaint,” Fabros said.
He said that on January 12, 2007, the CSC issued Memorandum Circular No. 01, series of 2007, to all head of government offices, including local government units, announcing the repeal of MC 17 known as “Policy Guidelines for Contracts of Service” and MC 24 which was also known as “Clarification on Policy Guidelines for Contracts of Service.”
According to Fabros, MC No. 01 s. 2007 specifically stated: “As a consequence, contracts of service and job orders will no longer be submitted to the Civil Service Commission Regional Offices (CSCROs) for review and requests for exemptions from said circulars will no longer be required with respect to hiring under contract of service or job order.”
“This is a clear embarrassment for the camp of Lazatin, which is clearly behind this legal booboo of Sanchez,” remarked Danilo de Austria Consumido, secretary general of the Partido Abe Kapampangan.
“Shakespeare would describe this case in two ways – ‘much ado about nothing’ or ‘all sound and fury signifying nothing’,” he added.
“And as if on cue, Lazatin’s barking dogs made so much noise out of a product of their own incompetence,” according to him.
“Lazatin’s camp has been quite trigger happy hurling charges left and right against Mayor Pamintuan right after he Lazatin announced his candidacy for mayor, charges that may be good propaganda but really are just hot air,” Consumido said.
Incensed job order workers at city hall, meanwhile, have announced of plans of a series of protest actions against Lazatin for “political harassment.”
They said their mass actions will be between 12 noon to 1 pm, so that “there will be no disruption of the legitimate services they render.”
