Dole’s order to boost confidence in manpower biz sector
CITY OF SAN FERNANDO — Pampanga Chamber of Commerce and Industry (PamCham) vice chairman Rene Romero hailed Thursday the Labor department’s new order that aims to eradicate “fly-by-night” contractors.
Romero said the Department Order (DO) 18-A, Series of 2011 is a boost to the manpower sector here as it provides clear-cut rules and regulations on contracting and subcontracting, and will curb abuses of the practice and boost workers protection.
Romero, who is among the initial framers of the order, said the DO will specifically weed out “fly-by-night” contractors who cannot fulfill the requirements of the law to operate their businesses.
“The manpower sector has experienced a lot of problems in the past because of these illegitimate practices of some fly-by-night companies. The bad image of the sector could be traced to these companies who have not been reasonable in their business practices,” Romero said.
He added the new order will bring renewed confidence in the sector as it aims to further strengthen well established companies that adhere to labor laws.
As a response to fully and effectively implement the new DO, the Dole-Central Luzon office held an orientation of the new order to officers and members of the Regional Tripartite Industrial Peace Council (RTIPC) last December 14.
Romero said the new order is proof that tripartite partners involving government, labor, and employers’ group can effectively harness the institution through tripartism and social dialogue in handling highly contentious and delicate issues such as security of tenure and subcontracting.
He said aside from the pertinent document requirements, a payment of P25,000 registration fee is also required upon the approval of the said registration.
On the other hand, registered contractors applying for renewal of their certificates of registration shall only do so 30 days before the expiration of their registration for them to remain in the roster of legitimate service contractors. They too, shall also pay P25,000 to the regional offices as renewal fee.
In addition to these labor standards, the new DO contains a new provision that entitles contractor’s employees to retirement benefits under the SSS or retirement plans of the contractor, if there is any. This is in addition to other entitlements of the workers under the previous DO.
The DO also clarifies the effect of termination of employment. Under Section 13, it provides that in case the termination of employment is caused by the pre-termination of the Service Agreement, the right of the contractor’s employees to unpaid wages, including legal mandatory contributions, shall be borne by the party at fault without prejudice to the solitary liability of the parties under the Service Agreement.
