Marquez: I won’t resign

FORMER Supreme Court spokesman Jose Midas Marquez turned down Tuesday calls for him to step down as court administrator, a position that he used to hold in a concurrent capacity during the aborted terms of ousted Chief Justice Renato Corona and retired Chief Justice Reynato Puno.
“Wala naman akong nakikita na rason para magbitiw (I find no reason to quit),” said Marquez on renewed calls made by the party-list group Akbayan.
Akbayan has been asking the Office of the Ombudsman to investigate Marquez for conflict of interest and involvement in the supposed mismanagement of a portion of the World Bank-funded Judicial Reform Support Program.
Marquez resigned last week as spokesman of the Supreme Court since this position is co-terminus with Corona, who was convicted by the Senate impeachment court for betrayal of public trust and culpable violation of the Constitution for not declaring his $2.4 million and P80-million bank deposits in his statement of assets, liabilities and net worth (SALN).
As court administrator, Marquez is tasked with the supervision and administration of the lower courts and their personnel. He also reports and recommends to the Supreme Court all actions that affect lower court management, personal and financial administration and administrative discipline.
According to Akbayan, Marquez had compromised his position as court administrator in allowing himself to become a mouthpiece for Corona, who appointed him, instead of speaking on behalf of the entire court.
But Marquez justified his “closeness” with Corona stemmed from his being an appointee of the ousted magistrate.
“The interaction between the Chief Justice and the spokesman will have to be often… We’re all humans; we work together every day, we become closer. This is something inevitable. Nakakalungkot yun dahil napalapit ka na dun sa tao. Tayo lahat naman ay may damdamin. Ang pinaglalaban natin ay judicial independence,” he said.
He also said that his appointment as court administrator, which has the rank and salary level of the presiding justice of the Court of Appeals, was made by the Supreme Court en banc, even before Corona was appointed chief magistrate.
“Ang nagtatalaga diyan yung Court en banc, at iyan ay may security of tenure until (I) reach the age of 65,” said the 45-year-old court official.
On working alongside Associate Justice Antonio Carpio, who became acting Chief Justice by operation of law being the next most senior justice, Marquez said that being a professional, he sees no problem with that.
“I have always been very professional with my work. Kung halimbawang hindi magiging maganda yung siguro yung relationship at maaapektuhan yung serbisyo, then that may be a time to think things over,” he said.
He narrated that after Corona was ousted by the Senate impeachment court, he continued to do his job as court administrator and even went to see Carpio the following day to ask what the magistrate wanted to do with the Public Information Office (PIO), which Marquez used to head, and whether he wanted to put someone there in his place during a transition.
Carpio then told him to “focus on being the Court Administrator for the time-being and let (Marquez’s deputy) Atty. Gleo Guerra to handle the PIO.” Marquez said he readily agreed, “OK, I’ll do that.”
Carpio had been blamed by Corona as one of those who was working for his ouster because of his own ambition to become Chief Justice.
Marquez said he knew about the brewing enmity between Corona and now acting Chief Justice Antonio Carpio even before the impeachment process started.
