Philex Mining faces another fine
MANILA, Philippines – Philex Mining is facing another fine, as well as possible suspension or cancellation of its environmental compliance certificate (ECC), over the tailings spill at its Padcal mine in Benguet.
In a disclosure to the stock exchange, Philex said it received a “notice of adverse findings” from the Environmental Management Bureau (EMB) of the Department of Environment and Natural Resources regarding the tailings spill.
Philex quoted the EMB report as saying “It was found that Condition no. 2 of the original ECC was violated which states ‘Pond effluent discharges shall conform with the standards set forth under RA 9275 otherwise known as the Clean Water Act of the Philippines and its implementing rules and regulations.”
Philex is now facing the suspension or cancellation of its ECC, as well as a P50,000 fine. The EMB said violations of the conditions under the ECC would be “sufficient cause for the suspension or cancellation of this certificate and/or imposition of fine in an amount not to exceed P50,000 for every violation thereof.”
The company said it will reply to the EMB contesting its findings and explaining why it should not be penalized.
At the same time, Philex said the tailings leakage from the pond has already been “effectively contained.” It said concrete spheres of various sizes, which have been used to plug the sinkhole, are also used as a filtering medium to the “small volume of water that continues to flow from the hole.”
Philex is also facing a P1 billion fine imposed by the Mines and Geosciences Bureau (MGB) for the tailings spill.
Philex has said the leak from its tailings pond last August 1 was caused by the “historically unprecedented heavy rains generated by Typhoon Gener at the Padcal site reaching 331.80mm on the day of the spill.”
The mine waste from Padcal then spilled into the Balog creek, and the Agno River, one of the country’s largest rivers.

The PNP still welcomed the complaint, saying the court is the proper venue to end the issue.
“We view this as an opportunity to clarify everything and close this chapter once and for all,” said Cerbo.
The P1.198-billion pistol deal, which was signed by Bartolome on September 20, will provide 59,904 units of 9mm Glock 17 Generation 4 pistols to the police force.
The purchase is seen to fill up the needed short firearms of policemen and would replace their old revolvers.
The delivery period for the service pistols is expected to be completed within 570 days. The first 12,000 units would be delivered sometime in February 2013.
