Proposed village info system ‘legal’

CITY OF SAN FERNANDO — The proposed Barangay Information System and Safety plan designed to curb criminality and create a database of transients living or working in Pampanga villages is legal, said the Provincial Board (PB).

Recently, the Bagong Alyansang Makabayan-Pampanga Chapter and the Kapampangan Kontra ID expressed opposition to the proposal in two separate statements, saying it was unconstitutional, violates the bill of rights, discriminatory and a threat to the privacy and security of Kapampangans.

But PB member Rolly Macalino, of the committee on peace and order, said the proposed ordinance, which has to undergo another public hearing before it is formally passed and approved, does not violate any existing law under the 1987 Constitution.

“The proposed ordinance does not actually violate existing law particularly our Constitution because the information to be given by a certain individual is the information required under the law,” he said.

He added that the barangay information system simply works to determine the “headcount” of barangay residents, particularly transients.

“This is to avoid criminality, particularly illegal elements staying in one barangay,” Macalino said.

He also said that there is already a Supreme Court ruling that does not invalidate the barangay ID system.

For first district Board Member Tarcicio DC Halili, the issues raised by the groups should be voiced out in the next hearing.

“There is going to be another hearing and it will be best for them to share their insights with the august body since we are stakeholders on this proposal,” he said.

Association of Barangay Captains president Melchor Pingol, for his part, said the village chiefs find no problem with the barangay information system.

“Hindi naman sagabal daw sa kanila ito. It’s for security reasons. Dapat talaga ma-register sila, particularly the transients dahil pag may nangyari, alam namin kung sino sila at saan naming hahanapin. For us, it not threatening or violating any law. In our last meeting with the barangay captains, they all agreed to implement it,” Pingol said.

Peace and order committee vice chairman Board Member Crisostomo Garbo and Board Member Nestor Tolentino agreed with Pingol, but said the national ID system is “not specifically” what the PB would implement in its proposal.

“There’s a decision from the Supreme Court. Very soon our Provincial Administrator [Andres Pangilinan Jr.] would inform the media with regard to this and the national ID system. But the national ID system is not what the PB would adopt. It’s not the same. Ours is to compel transients to register in the barangay just for information. There is no violation and threat to their privacy. With due respect to the groups opposing it, they should join the next committee hearing,” noted Garbo.

Tolentino agreed with Garbo, saying the barangay information system was just for inventory purposes.

“What we want to clarify is that the barangay information system and safety plans just for inventory or headcount. We will not in any way include their properties. We will definitely not do that. We will not approve a proposal that will threaten the privacy or rights of our constituents,” Tolentino said.
