Raps vs Corona pushed

MANILA — The lead public prosecutor in the impeachment trial of ousted Chief Justice Renato Corona said the government should continue to probe the former Supreme Court (SC) official despite his removal from office.
“The Ombudsman should continue the investigation using the evidence submitted by the prosecution to the Senate,” prosecutor and Representative Niel Tupas Jr. (Iloilo) said in a text message.
In her testimony before the Senate impeachment tribunal last month, Ombudsman Conchita Carpio-Morales said her office started conducting a fact-finding investigation after three complaints were filed against Corona.
In a 20-page memorandum report signed by Morales, the Ombudsman said Corona may have violated the Anti-Money Laundering Act.
“The undersigned investigators respectfully submit that the foregoing findings may involve a violation of Republic Act (RA) 9160 as amended by RA 9194 (The Anti-Money Laundering Act),” the report stated.
“In addition, the acquisition of wealth by subject Corona appears to be grossly disproportionate to his known income as a public officer,” it added.
The Ombudsman report also said that Corona’s “possible unexplained wealth” from 2001 to 2012 amounts to P677.37 million. Corona was appointed as an associate justice of the Supreme Court in 2002 and as chief justice in 2010.
The Office of the Ombudsman is a body that the executive branch has no control of, Malacañang said.
“It is moving on its own, so we have no control over what the Ombudsman would do based on the complaints filed and based on the discoveries and admissions made by Mr. Corona in the impeachment trial,” said presidential spokesperson Edwin Lacierda.
Senator Edgardo Angara, one of the 20 senator-judges who voted for Corona’s conviction, earlier said that Corona’s removal from office is enough punishment and that the government “should end there.”
The senator’s son, Representative Sonny Angara (Aurora), said the prosecution will leave it to the government agencies to do its job. Angara is one of the spokespersons of the House panel.
House Deputy Speaker Erin Tañada, also a spokesperson for the impeachment prosecutors, however, pointed out that it would be the Ombudsman who would violate her constitutional duty if she will not conduct the investigation on the former Chief Justice.
“The government should not forget pursuing possible tax or criminal liability against ex-CJ Corona. As a matter of fact, the Ombudsman, as an independent office under the Constitution, is tasked to conduct an investigation and file the appropriated charges if warranted,” Tañada stressed.
Justice Secretary Leila de Lima earlier said the other cases that can be filed against Corona should be pursued even if he was already removed from office.
The Justice secretary said if there is sufficient evidence that Corona has committed other violations of the law, the latter should be held liable.
She stressed that it will not be good for the country if the other possible violations of Corona will be taken for granted, especially that government aims to strengthen “truth and accountability” for its officials.
De Lima also said that the Office of the Ombudsman and the Bureau of Internal Revenue (BIR) are the government agencies who should run after Corona.
Meanwhile, Malacañang also defended BIR Commissioner Kim Henares, who is also tasked to investigate Corona’s possible tax evasion case, saying she might be accused of dereliction of duty if she would not continue the probe against the former chief magistrate.
“As you know when Commissioner Kim Henares testified (at the Senate impeachment court), she said she will issue a letter of authority to Mr. Corona. The problem is if Mrs. Henares would not act, she could be accused of dereliction of duty or others might say there is law for the rich and there is another law for the poor,” said Lacierda.
He cited the case of Delsa Flores, a former court interpreter in Davao who was removed from her work after she failed to declare a market stall on her statement of assets, liabilities, and net worth (SALN).
He said it is now up to Henares to continue with the investigation.
The BIR will use the waiver that Corona signed before the impeachment court to check if the former Chief Justice paid the right taxes.
